These Terms of Service ("Terms") govern your use of the Kool Springs bottled water delivery services, subscription plans, and cooler rentals. By placing an order or using our website, you agree to these Terms. If you do not agree, do not use the services.
1. Who We Are
Kool Springs ("we", "us", "our") supplies bottled water and related services to customers in our delivery areas across Ontario, Canada.
2. Eligibility
- You must be of legal age to contract in Ontario to order our services.
3. Services We Provide
- Bottled water delivery (reverse osmosis, spring, distilled) in 18L and 11L formats.
- Recurring subscriptions and one-time orders.
- Cooler rentals and cooler purchases (where offered).
- Related delivery accessories and deposits as disclosed at checkout.
4. Orders, Pricing, Taxes, and Fees
- All prices are shown in Canadian dollars (CAD) and are subject to applicable taxes (e.g., HST in Ontario).
- Delivery fees, rush fees, and bottle deposits are disclosed at checkout. Bottle deposit details are in our Bottle Deposit Policy.
- We may correct errors in pricing or product information and will notify you if changes affect an open order.
5. Payment
- We accept the payment methods shown at checkout (e.g., card payments, cash on delivery, e-transfer).
- For subscriptions, recurring charges are billed per delivery based on the items and frequency you select.
- If a payment fails, we may pause deliveries until payment is resolved.
6. Subscriptions, Skips, and Changes
- Contact us to adjust items, quantities, and delivery frequency. Changes may require one business day to take effect.
- You may skip a delivery before the cutoff we confirm with you; charges and deposits adjust on the next invoice.
- We may refuse or limit service where delivery is unsafe, inaccessible, or outside our service area.
7. Bottle Deposits & Returns
- A refundable deposit is charged on 18L and 11L bottles as disclosed at checkout.
- Deposits are credited when bottles are returned in reusable condition. Damaged or missing bottles may forfeit the deposit.

8. Cooler Rentals & Purchases
- Rental fees are billed monthly. You may cancel rentals by contacting us; we will schedule pickup of the unit.
- Rental units must be returned in reasonable condition. Damage beyond normal wear may incur fees.
- Cooler purchases are final; manufacturer warranties apply where available.
9. Delivery, Risk of Loss, and Access
- We deliver to the locations and time windows we confirm with you. Please provide safe, accessible drop-off points.
- Risk of loss transfers when products are delivered to the address or drop spot you provide.
- If we cannot deliver due to access issues, we may reschedule and charge any applicable return or redelivery fee.
10. Returns, Refunds, and Quality Issues
- If you receive the wrong item or a quality issue, contact us within 24–48 hours so we can replace or credit the affected items.
- Perishable water products are generally non-returnable once delivered, except for errors or quality defects.

11. Acceptable Use
- Do not misuse the website or services (e.g., interfere with operations, attempt unauthorized access, or resell without permission).
- Use products only for their intended purpose and follow handling instructions for bottled water and equipment.
12. Service Changes and Availability
We may update products, pricing, delivery schedules, or these Terms. Material changes will be posted here with the updated date. If you continue to use the services after changes take effect, you accept the updated Terms.
13. Warranties and Disclaimers
- The services are provided "as is" and "as available."
- To the fullest extent permitted by Ontario law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the fullest extent permitted by Ontario law, Kool Springs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the services is limited to the greater of (a) the amount you paid for the service giving rise to the claim in the last three (3) months, or (b) CAD $100.
15. Indemnity
You agree to indemnify and hold Kool Springs, its affiliates, and personnel harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the services or violation of these Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be brought exclusively in the courts of Ontario (and the federal courts of Canada, as applicable), and you agree to that forum.
